Magic Maintenance Plan Terms of Service
(Formerly the Automation Assurance Plan)
By subscribing to the Magic Maintenance Plan, you agree to the following terms and conditions:
1. Service Inclusions
The Magic Maintenance Plan provides ongoing support and maintenance for your existing automations once they are in maintenance mode, which includes:
- Proactive Monitoring: I will monitor your automations regularly to identify and resolve issues before they impact your business.
- Proactive Troubleshooting and Correction: If any errors or glitches are detected, I will address them promptly to ensure your automations continue running smoothly.
- Minor Adjustments: Modifications to existing zaps, automations, Airtable tables, or interfaces that I have already built for you.
- Priority Access: You will have priority access to me via email, phone, text, or chat, and I will respond to inquiries or requests as quickly as possible.
- Discounted Hourly Rate: While on the plan, any new project work will be billed at a discounted per our agreement.
2. What Is Not Covered
The Magic Maintenance Plan does not include:
- New Projects or Major Updates: This includes the creation of new Airtable automations, tables, interfaces, or new Zapier zaps. These changes will be treated as new project work and billed separately.
- Third-Party Costs: The cost of third-party tools (e.g., Zapier, Airtable) is not included in the Magic Maintenance Plan. These are separate subscriptions that you will be responsible for managing and paying directly.
3. Payment and Billing
- The Magic Maintenance Plan is billed automatically on the same date each month that you originally signed up.
- Payment will be automatically charged to the payment method provided at the time of subscription.
- Failed Payments: If a payment fails, you will have 7 days to resolve the issue. If payment is not resolved within this period, your Magic Maintenance Plan will be canceled, and all services will be suspended.
- Cancellation: You may cancel your subscription at any time. Services will remain active until the end of the current billing cycle. After that all work will be billed at the undiscounted rate.
4. Response Times
- For Magic Maintenance Plan members, I aim to address any issues or requests within 24 hours (during business days). In urgent cases, you will have priority access and receive immediate attention where possible.
- Non-plan clients or clients without an active maintenance plan may expect a response within 48 business hours and will be billed at the standard current rate with a minimum charge of 30 minutes.
5. Written Confirmation for Additional Billable Work
For any work that falls outside of the defined maintenance services, I will always obtain written confirmation from you before proceeding. This ensures transparency and that you are aware of any billable work that would be completed at the discounted rate.
6. Definitions
- Project Phases: Each project follows a three-phase timeline, which includes Build, Testing/Tweaking, and Maintenance Mode. Transitions between phases will be determined collaboratively, with both parties agreeing on the appropriate time to move forward.
- Build Phase: This phase covers the initial setup and development based on the agreed-upon project specifications. The Build Phase concludes once the foundational system is in place and ready for real-world testing. I will notify you when I believe the project is ready to progress to the Testing/Tweaking Phase.
- Testing/Tweaking Phase: During this phase, the system undergoes active testing by the client to ensure it meets the initial project specifications under real-world conditions. Minor adjustments, or “tweaks,” may be made to improve performance or resolve issues that arise during regular use. If significant changes are identified that require foundational updates, both parties may agree to revert temporarily to the Build Phase to complete those modifications. I will communicate with you when I believe the system is stable and ready for Maintenance Mode, and both parties will mutually agree on the transition to this phase.
- Maintenance Mode: Maintenance Mode begins once the system has operated consistently and reliably for a sufficient period without requiring additional adjustments. At this stage, the focus shifts to monitoring, proactive troubleshooting, and minor adjustments to keep the system running smoothly. Any work beyond minor adjustments, such as new features or significant modifications, will be treated as new project work.
- Minor Adjustments: Small refinements made to the existing system that enhance or slightly modify functionality without adding new features. Examples include updating fields, adjusting existing formulas, or changing trigger conditions in automations or workflows to improve the current setup.
- Major Updates: Major updates involve the addition of new features, significant modifications, or the creation of new workflows, tables, automations, or interfaces. These changes are considered new project work and will follow a separate Build, Testing/Tweaking, and Maintenance cycle.
7. Changes to Terms
I reserve the right to update or modify the terms and conditions of the Magic Maintenance Plan. Any changes will be communicated to active subscribers with at least 7 days’ notice.
8. Limitation of Liability
I am not liable for any downtime, loss of revenue, or other damages that may arise from issues related to third-party software, services, or tools that are beyond my control (e.g., Zapier or Airtable outages, or API changes).
Acknowledgment
By subscribing to the Magic Maintenance Plan, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
